1. Definitions
General Sales ConditionsThe general sales conditions constitute the set of rules that will be applied to the purchase of Miniconf products (the "Products") through the website www.miniconfshop.it. The General Sales Conditions are formulated in accordance with the legislation on contracts concluded outside of commercial premises, particularly in accordance with Legislative Decree April 9, 2003, n. 70 (Implementation of Directive 2000/31/EC on certain legal aspects of information society services in the internal market, with specific reference to electronic commerce) and Legislative Decree September 6, 2005, n. 206 (Consumer Code), and subsequent amendments and integrations.
Contract Parties
The parties to the contract are:
- Miniconf S.p.A. with headquarters in Ortignano Raggiolo 52010 (Ar), Via Provinciale 1/a, VAT number 00249390519 - REA AR 64978.
- Customer, for the purposes of these General Sales Conditions, means the natural person or other legal entity who purchases the Products through the website www.miniconfshop.it.
2. Subject
2.1 The General Conditions govern the relationship between the Customer and Miniconf S.p.A. for the purchase of Products from time to time made available on the site www.miniconfshop.it. 2.2 Miniconf S.p.A. reserves the right to modify the General Sales Conditions at any time, with the understanding that the applicable General Sales Conditions will be those published on the website www.miniconfshop.it at the time of sending purchase proposals for the Products (the "Orders") by the Customers. 2.3 In case of conflict between the General Sales Conditions and any other terms and conditions related to the Sales Contracts published on the Online Store, the more favorable terms and conditions for the Customers will apply. 2.4 The sales contracts concluded by accessing the website www.miniconfshop.it are governed by Italian law, particularly Legislative Decree April 9, 2003, n. 70 (Implementation of Directive 2000/31/EC) and Legislative Decree September 6, 2005, n. 206 (Consumer Code), and subsequent amendments and integrations.3. Registration on the Site
Registration with a "username" and "password" is optional but offers the advantage of storing the order history and tracking your Orders. However, if the Customer does not wish to register, they can still complete the purchase through the fast checkout procedure, in which case only the data necessary for shipping, delivery, and payment of the Order will be requested.4. Conclusion of Sales Contracts
4.1 Miniconf S.p.A. commits to sending Customers an Order shipment confirmation (the "Confirmation") within 3 working days of receiving the Orders from the Customers. 4.2 The Sales Contracts are concluded between the Parties when Customers receive the Order Confirmation. If Customers do not receive the Order Confirmation within the period specified in article 4.1, the Order should be considered rejected by Miniconf S.p.A. and therefore without effect. Miniconf S.p.A. is not responsible for malfunctions depending on the data transmission network operator. 4.3 By sending Orders, Customers acknowledge and declare that they have read all the information provided during the purchase procedure and fully accept the General Sales Conditions as well as all the further information contained in the Online Store. 4.4 The Orders will be stored in the Online Store database according to the procedures and in compliance with the provisions of Legislative Decree June 30, 2003, n. 196 ("Privacy"), and will be accessible by contacting Miniconf S.p.A. at the references specified in article 1 or by accessing the folder related to their profile containing personal information (the "Profile").5. Product Availability
5.1 Except as provided in article 5.2, for each Product published in the Online Store, Miniconf S.p.A. indicates whether it: (i) is available in its warehouses; (ii) is not available in its warehouses. 5.2 All Products are subject to availability at the time. Miniconf S.p.A. reserves the right to change the type and availability of Products published in the Online Store at any time without any liability towards Customers. 5.3 The indication regarding Product availability is not binding, with the understanding that Products indicated as "unavailable" under article 5.1 (ii) cannot be ordered by Customers. In case of subsequent unavailability of one or more Products indicated as available when sending the Order by a Customer, Miniconf S.p.A. commits to promptly informing the Customer via email, proposing an alternative if possible. In this case, subject to the right of withdrawal provided in article 10, the Customer can integrate or confirm the Order within 48 hours of receiving the email by replying to it. If no response is received from the Customer within 48 hours, Miniconf S.p.A. will proceed to complete the shipment of the available Products. In the case of payment by credit card or PayPal, Miniconf S.p.A. will process the payment at the time of the order, and the unavailable Products will be immediately refunded to the Customer. In the case of payment by bank transfer, Miniconf S.p.A. will promptly refund an amount equal to the value of the unavailable Products.6. Shipping Costs
The displayed shipping costs are calculated based on the quantity and weight of the products in the cart. The final shipping cost will be shown during the purchase process.7. Return Policy
Products must be returned within 14 days of delivery. Returned products must not have been worn, washed, or altered in any way. Returned products must have all their original tags and be in their original packaging. Completing the return process is mandatory (see below for more details).7.1 Merchandise Exchange
If you wish to exercise the right of return for the entire order or one or more items purchased, we invite you to complete the Return Process.- Communicate your intention to return via email to [email protected], specifying your order number and the items you wish to return, or, if you have registered on the site, you can download the return request form;
- The products must not have been used, worn, washed, or damaged;
- The products must be returned intact in their original packaging with all tags and shipped within 14 working days from the date of receipt to: Miniconf Shop, c/o Miniconf S.p.A., Magazzino Ferrantina 3, Via dell’Artigiano 69, 52011, Bibbiena (AR), Italy
- Miniconf reserves the right to refuse damaged and/or used items.
The cost of returning the product(s) to our warehouse, either via courier or postal service, is solely at the customer's expense.
In the case of an exchange, your new product(s) will be shipped once we have received the original product(s). If an exchange is not desired, a refund can be requested. First, please communicate your intention to return via email to [email protected]. The administrative costs of refunds are borne by Miniconf S.p.A. Conversely, all shipping costs for the product, either via courier or postal service, are the responsibility of the customer. The customer will then be refunded the value of the returned product.
(1) The store operates from the European Union, and therefore all transactions, even in foreign currency, are converted into Euro following the customer's payment. (2) Returned products paid for by bank transfer are refunded via bank transfer. For the refund, the customer must provide bank details to customer service. The required data are IBAN and the account holder's name.
The refund will be processed as soon as the returned product arrives at our warehouse and its integrity is verified. Note: if payment is made by credit card, refunds may take up to 4 weeks to be visible on your statement. The refund will appear on your statement with the description 'Miniconf S.p.A.'.
8. Customer Assistance
All information about the status of your orders will be visible on your account, which you will access once you have registered with your email and password. For more information regarding your online purchases on the website www.miniconfshop.it, you can contact us at the email address [email protected] or by phone at 0575/533570. Our customer service will answer your questions from Monday to Friday from 9:00 to 12:00 and from 14:00 to 17:00 (Rome/Paris/Berlin time), excluding holidays.9. Copyright and Trademarks
The design of the website www.miniconfshop.it and all the material contained therein (the trademarks, logos, HTML code, scripts, texts, drawings, images, and products) are an integral part of the Miniconf online store and are protected by copyright. Any unauthorized use of such content, such as copying, inclusion in frames, and association with content not originated from this online store, is not permitted and will be prosecuted according to the law.Sarabanda - Minibanda - iDO are registered trademarks owned by Miniconf S.p.A.
